Spay and Neuter Contract
Permanent ownership of this dog is contingent upon your compliance with this Agreement. Proof of the spay/neuter must be received by the purchaser and/or new owner within fourteen (14) days after the surgery. In the event that the dog’s health does not allow this agreement to be honored, Seller must be provided with a statement from your veterinarian that this dog is not yet in physical or emotional condition for surgery. Based upon the veterinarian’s evaluation of this dog the (purchaser) will contact the veterinarian and establish the earliest date that the procedure can be performed. (THE PURCHASER) will notify the BREEDER of this amendment in writing at which time all other conditions of this agreement will apply and be enforced.
It is the responsibility of the PURCHASER, not the veterinarian, to ensure that Seller has received verification that the surgery has been performed. Failure to comply with this agreement by the date below, unless otherwise agreed to in writing, will be considered a breach of the contract, and PURCHASER will pay to transport or transport this dog back to Florida Pom and will not be entitled to a refund.
If not spayed/neutered then the additional penalty due is $4,000.00 additional to the pet price. Please send the vet’s proof of neuter or invoice bill with the vet’s state license number and his/her signature for verification.
By my signature below, I agree to have this dog spayed/neutered by a year of age and I understand that this spay/neuter agreement is an agreement that this dog will not produce a litter of puppies either as purposely bred or by accidental breeding. Accidental breeding is considered neglect and the dog/bitch will be returned to us and all puppies born from any breeding, accidental or otherwise, will become the property of Florida Pom. I also agree that should puppy not be altered that I will return said puppy back to Florida Pom with no refund.
This means that you will be granted temporary custody of this dog. Upon our receipt of this puppy’s proof of spay/neuter from your veterinarian. Failure to provide to the breeder the proof of spay/neuter of this dog by a year of age will nullify this agreement and the purchaser will deliver or pay to deliver the puppy and return it in good health to the breeder and surrender the puppy to breeder without financial restitution or compensation of any kind.
You do agree that if you ever cannot keep the puppy, for the lifetime of the dog, that you will return the puppy to the breeder and we will gladly take the puppy/dog back. You agree that you will never surrender the pup/dog to a shelter or pound, the pup/dog will be returned to us.
You agree that you will not ever sell or give the puppy/dog away. If you, your immediate family or children cannot properly care for the dog then the pup/dog will be returned to us to have a home here at Florida Pom.

Also, In a perfect world we would like to have each puppy we place to stay in their original purchasing home. Things do happen, should you be unable to fulfill this contract by the above-agreed date, you agree to contact Florida Pom, in writing, phone or email and let us know BEFORE the puppy has been placed into a new home. We require a right of first return or reclamation, that the puppy be returned to us if you cannot keep him or her. You are not free to give the puppy away to another family member or anyone without receiving permission from us first. We require this so we can keep track of all our babies for their lifetime.
Health Guarantee: The Seller guarantees this puppy to be of sound health at the time of this sale. The Seller will provide a health record of all shots, de-worming, and a negative fecal exam. The Buyer agrees to take this puppy to a licensed veterinarian of their choice within 72 business hours excluding weekends for a physical exam. Failure to have the puppy examined by a vet within 3 days of the date the puppy is delivered/ picked up or if the Buyer fails to provide required immunizations and medical treatment this health guarantee will be null and void. Dehydration, Diarrhea, Hypoglycemia, Coccidia, Kennel cough, Internal and external parasites, Giardia, Fungal infections, or any condition that can be contracted after the puppy leaves the premises and can be corrected by veterinarian treatment and any other preventable conditions are not covered.
We provide a one (1) year, from whelping date health guarantee for life-threatening health issues. Illnesses/defects must be documented in writing by a licensed veterinarian. The Seller must be notified that the examiner indicated that at the time of sale, such animal was unfit for purchase, due to life-threatening illness, disease, or congenital defect. This notification must include proper documentation by a licensed veterinarian. If the puppy was in fact, unfit for purchase, the Buyer may return the puppy to us for an exchange of equal value at some point in the future. The Seller will offer a replacement puppy of comparable value but no money will be refunded. This is subject to availability, breeder’s first choice for our breeding program, then the Buyer’s interests second. The failure to do this within 72 hours of receipt of the puppy or within 72 hours of veterinarian determination of defect within the 1-year window will result in the cancellation of a replacement puppy offer. Conditions not considered life-threatening and therefore not covered include but not limited to luxating patella, hernias of any kind, collapsed trachea, etc. If the condition can be treated, it is NOT considered life-threatening and not covered within this health guarantee. In the event of a life-threatening condition, the affected puppy must be returned veterinary documentation at Buyer’s expense. The Buyer understands that a replacement puppy will only be given if it’s discovered to be a hereditary problem and not due to accident or illness.
WE DO NOT GUARANTEE color, the adult size, testicles descending, retained teeth, bite alignment, weight, hernias, physical flaws, or temperament of the puppy.
Any puppy purchased from Florida Pom must show a life-threatening hereditary defect by 12 months of age. Dogs older than 12 months are not covered under this guarantee [unless otherwise approved]. If after the Buyer discovers a life-threatening condition within one (1) year of purchase and the Buyer wishes to retain the puppy, the Buyer then waives the right to a replacement puppy unless otherwise agreed upon in writing from the Breeder outlining such terms. Shipping charges on any replacement puppy is the responsibility of the Buyer. If the puppy is found to have a life-threatening or hereditary condition that requires the dog to be euthanized, documentation by the Buyer’s veterinarian must be provided to the Seller and must show an untreatable, medical issue severe enough
The Buyer of a puppy from Florida Pom, hereby acknowledges that the Buyer has received a copy of this document acknowledges and agrees to the terms and accepts full responsibility for the health and well-being of the purchased puppy. This document is considered the complete “Bill of Sale.” Furthermore, issuance of the deposit from the Buyer, and acceptance of the deposit by the Seller constitutes acceptance of all of the terms and conditions contained herein. This agreement represents the total agreement between Florida Pom and the Buyer and no other terms or conditions shall be valid regarding this sale.
This contract is still your responsibility to enforce in the puppy’s new home, should we not receive confirmation of the puppy’s spaying or neutering by the above listed date, as the original purchaser, you will then be liable for the dogs full purchase breeding value, which can be up to three to five times higher than the purchased pet value.
Healthiness is Happiness
Vaccination Limitations: Your puppy has not been fully vaccinated and the recommended vaccination protocol schedule outlined below must be continued in order to maintain the one (1) year health guarantee. The Buyer must have all immunizations done by a licensed veterinarian and provide proof of treatment to Seller upon request.
- 8-10 Weeks Old: Distemper + Parvovirus, MLV (e.g. Merck Nobivac [Intervet Progard] Puppy DPV) (COMPLETED BY SELLER)
- 14-16 Weeks: Same as above
- 24 Weeks or Older (if allowable by law): Rabies
- 1 Year: Distemper + Parvovirus, MLV (optional = titer
- 1 Year after the initial dose: Rabies, 3-year product (give 3-4 weeks apart from distemper/parvovirus booster)
- Bordetella: every 6 months as appropriate.
It is our recommendation that the puppy not be given any LEPTO vaccination.
